2. Cleanserv Services
Cleanserv offers a platform for users to book and access cleaning services. These services may include but are not limited to residential cleaning, commercial cleaning, and specialized cleaning services. By using the Website or Services, you acknowledge that Cleanserv can access your data.
3. Registration and Account
To use certain features of the Website, you may be required to create an account. You agree to provide true, up-to-date, and complete information when registering for an account, and to promptly update this information if there are any changes.
You are solely responsible for keeping your account credentials secure and for any activities conducted under your account. If you notice any unauthorized access or security breach related to your account, you agree to notify Cleanserv immediately.
4. Use of Services
Cleanserv grants you a limited, non-exclusive, non-transferable license to access and use the Website and Services for personal and non-commercial purposes, subject to these Terms and Conditions. You may not use the Website or Services for any unlawful purpose or in a manner that violates the rights of others or disrupts the operation of the Website.

6. Fees and Payment

Payment for services must be made through the payment methods accepted by Cleanserv, including credit/debit cards, mobile payments, or other available payment methods. You agree to provide accurate payment information and authorize Cleanserv to process payments for the services rendered.
7. Cancellation and Refund Policy
You may cancel or reschedule your cleaning services in accordance with the Cleanserv cancellation policy. Cancellations made within a specified time frame (usually 24 hours) may be eligible for a full or partial refund, subject to the terms and conditions outlined at the time of booking.
Refunds for cancellations made outside the allowed time frame may be subject to a cancellation fee. Cleanserv reserves the right to deny refunds for cancellations made within the prohibited time window or in violation of the cancellation policy.
8. Customer Responsibilities
As a customer, you agree to provide accurate information about your cleaning needs and the property to be cleaned. You are responsible for ensuring that the area to be cleaned is safe and accessible for the Contractor to perform their duties.
You agree to be present at the time of service or make arrangements for access to the property. Cleanserv and its Contractors are not responsible for any damage, loss, or theft that may occur while cleaning your property.
9. Privacy and Data Protection
Cleanserv values your privacy and is committed to protecting your personal information. We collect, store, and use your data according to our Privacy Policy, which is available on the Website. By using the Services, you consent to the collection and processing of your data as outlined in the Privacy Policy.
Cleanserv will not share your personal information with third parties without your consent, except as necessary to facilitate the provision of Services or as required by law.
10. Limitation of Liability
To the maximum extent permitted by law, Cleanserv shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Website and Services. This includes, but is not limited to, damages for loss of profits, loss of data, or damage to property.
Cleanserv does not assume responsibility for any damages, injuries, or losses resulting from the actions or negligence of Contractors. Cleanserv’s liability is limited to the total amount paid by the user for the specific service in question.
11. Indemnification
You agree to indemnify and hold Cleanserv, its affiliates, directors, officers, employees, and Contractors harmless from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Website, Services, or any breach of these Terms and Conditions.
This obligation to indemnify shall remain in effect even after this Agreement ends or is terminated.
12. Intellectual Property
Cleanserv or its licensors own all content on the Cleanserv Website, including text, images, logos, graphics, and software, and protect it under copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content from the Website without the prior written consent of Cleanserv.
13. Modifications to the Terms and Conditions
Cleanserv reserves the right to modify, update, or change these Terms and Conditions at any time. Any changes will be posted on the Website, and the “Last Updated” date will be revised accordingly. By continuing to use the Website and Services after changes are made, you agree to the updated Terms and Conditions.
14. Governing Law
This Agreement is governed by the laws of South Africa. Any disputes arising from your use of the Website or Services shall be subject to the exclusive jurisdiction of the courts of South Africa.
15. Dispute Resolution
In the event of any disputes or claims arising from the use of the Website or Services, Cleanserv encourages you to first attempt to resolve the matter amicably by contacting our support team. If a resolution cannot be reached, you may seek alternative dispute resolution (ADR) methods, such as mediation or arbitration, before pursuing legal action.
16. Force Majeure
Cleanserv shall not be liable for any failure or delay in the performance of its obligations under this Agreement due to events beyond its reasonable control, including but not limited to natural disasters, acts of war, labor strikes, or technical failures.
17. Severability
If a court of law finds any provision of these Terms and Conditions invalid or unenforceable, the remaining provisions will stay in full effect. We will modify the invalid or unenforceable provision as needed to make it enforceable.
18. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Cleanserv concerning your use of the Website and Services. This Agreement supersedes any previous agreements or understandings, whether oral or written.
